Requirements depend on your entity type and who performs the work. Some sole proprietors and certain corporate officers may be exempt. Calling someone an independent contractor does not automatically make them exempt, because New York looks at the actual working relationship when deciding whether a person is an employee for worker’s compensation purposes.
No. A Certificate of Attestation of Exemption, Form CE-200, does not update Workers' Compensation Board records and cannot be used to resolve an existing penalty. Getting coverage in force and properly filed is the first step.
